1. Introduction and Acceptance of Terms

  • 1.1. Purpose:
    Al Habib Educational Welfare and Trust (hereinafter referred to as
    “the Trust” or “the NGO”) is a non-profit organization
    established in Madhubani, Bihar, India. Our core mission is to promote education,
    particularly for girls, and engage in social welfare activities to uplift
    underprivileged communities.
  • 1.2. Scope:
    These Terms and Conditions govern the operations of the Trust, its various
    educational and social welfare programs, and define the relationship
    between the Trust, its beneficiaries, volunteers, donors, partners, and
    the general public.
  • 1.3. Acceptance:
    By participating in our programs, volunteering, making a donation, or
    otherwise engaging with the Trust, all individuals and entities agree to
    be bound by these Terms and Conditions. The Trust reserves the right to
    amend these terms periodically, and the most current version will always
    be available on the Trust’s official communication channels.

2. Mission, Vision, and Objectives

  • 2.1. Mission:
    To empower individuals and communities, especially girls, through access
    to quality education and targeted social welfare initiatives, fostering
    self-reliance, dignity, and sustainable development in Madhubani, Bihar.
  • 2.2. Vision:
    A society where every individual, regardless of their background, has the
    opportunity to learn, grow, and contribute meaningfully.
  • 2.3. Core Objectives:

    • To establish and support educational initiatives
      focused on girls’ learning, from foundational literacy to higher education.
    • To implement skill development programs that equip
      beneficiaries with practical, marketable skills for livelihood
      enhancement.
    • To undertake social welfare projects addressing
      critical community needs, such as health awareness, sanitation, and
      women’s empowerment.
    • To provide a safe, inclusive, and encouraging
      environment for all participants and beneficiaries.
    • To promote ethical values, civic responsibility, and
      community participation.
    • To ensure transparent and accountable utilization of

3. Beneficiaries and Program
Participation

  • 3.1. Target Beneficiaries: The Trust primarily focuses its efforts on girls and
    underprivileged individuals and communities within Madhubani, Bihar.
  • 3.2. Program Eligibility: Specific criteria may apply to participation in
    various educational or social welfare programs, based on the program’s
    objectives, funding, and target demographic. These criteria will be
    clearly communicated for each specific program.
  • 3.3. Voluntary Participation: Participation in any Trust program is entirely
    voluntary. Beneficiaries are expected to adhere to program guidelines and
    demonstrate respect towards staff, volunteers, and fellow participants.

4. Donations and Financial

    corporations, and other entities to support its charitable objectives.
  • 4.2. Utilization of Funds: All donations received by the Trust will be utilized
    solely for the furtherance of its stated mission and objectives, including
    program implementation, administrative costs, and infrastructure
    development.

    The Trust is committed to financial transparency. Annual financial
    reports, including details of income and expenditure, will be prepared and
    made available for review as per legal requirements and best practices.

    Donations made to Al Habib Educational Welfare and Trust may be eligible
    for tax exemption under relevant sections of the Indian Income Tax Act,
    1961 (e.g., Section 80G). Donors will be provided with appropriate
    receipts for their contributions. Eligibility for exemption is subject to
    prevailing tax laws.
  • 4.5. Refund Policy for Donations: Donations, once made, are generally non-refundable. In
    exceptional circumstances, and at the sole discretion of the Trust’s
    management, a refund may be considered.

5. Volunteer Engagement

  • 5.1. Voluntary Nature: Volunteers contribute their time and skills on a
    purely voluntary basis without expectation of monetary compensation, unless
    explicitly agreed upon for specific, defined roles.
  • 5.2. Code of Conduct:
    Volunteers are expected to adhere to the Trust’s code of conduct, respect
    the beneficiaries, staff, and organizational values. Any behavior
    inconsistent with the Trust’s mission or the safety of beneficiaries will
    result in immediate termination of the volunteering engagement.
  • 5.3. Confidentiality:
    Volunteers may have access to sensitive information about beneficiaries or
    the Trust’s operations. They are required to maintain strict
    confidentiality of such information.
  • 5.4. Background Checks: For roles involving direct interaction with children
    or vulnerable individuals, the Trust reserves the right to conduct
    background checks on prospective volunteers as deemed necessary for safety
    and compliance.

6. Ethical Conduct and Safeguarding

  • 6.1. Child Protection: The Trust is committed to providing a safe environment
    for all children involved in its programs. All staff, volunteers, and
    partners are required to adhere to strict child protection policies and
    protocols in accordance with the Protection of Children from Sexual
    Offences (POCSO) Act, 2012, and other relevant Indian laws. Any concerns
    regarding child safety must be reported immediately.
  • 6.2. Professionalism and Respect: All individuals associated with the Trust, whether
    staff, volunteers, or partners, are expected to conduct themselves with
    the highest degree of professionalism, integrity, and respect towards all
    individuals, irrespective of their background.
  • 6.3. Anti-Harassment Policy: The Trust maintains a zero-tolerance policy against
    any form of harassment, discrimination, or abuse.
  • 6.4. Grievance Redressal: The Trust will establish clear procedures for
    reporting and addressing grievances or concerns from beneficiaries, volunteers,
    staff, or the public.

7. Data Privacy and Communication

  • 7.1. Collection of Information: The Trust will collect necessary personal and
    sensitive information from beneficiaries, volunteers, donors, and partners
    for program administration, communication, fundraising, and reporting
    purposes. This information will be collected and processed in accordance
    with applicable data protection laws in India.
  • 7.2. Confidentiality:
    The Trust is committed to protecting the privacy of personal information
    and will not disclose it to third parties without consent, except as
    required by law or for the legitimate purposes of the Trust.
  • 7.3. Use of Data:
    Data collected will be used for purposes such as program delivery, impact
    assessment, donor communication, official reporting, and promoting the
    Trust’s work.
  • 7.4. Photography/Videography Consent: The Trust may capture photographs or videos of program
    activities, beneficiaries, and events for promotional, educational,
    archival, or reporting purposes. By participating in programs or events,
    individuals provide implied consent. Any individual wishing to opt-out of
    their image being used must inform the Trust in writing. Specific consent
    forms may be used for minors.
  • 7.5. Communication:
    By providing contact details, individuals consent to receive
    communications from the Trust regarding its programs, updates, fundraising
    appeals, and events. Individuals may opt-out of such communications at any
    time.

8. Disclaimers and Limitations of
Liability

  • 8.1. No Guarantees:
    While the Trust strives to deliver high-quality programs and maximize
    impact, it cannot guarantee specific outcomes for beneficiaries or
    solutions to all social challenges.
  • 8.2. Force Majeure:
    The Trust shall not be held liable for any delay or failure in performance
    arising from causes beyond its reasonable control, including but not
    limited to acts of God, natural disasters, war, terrorism, epidemics, government
    regulations, or civil unrest.
  • 8.3. Personal Property: The Trust is not responsible for the loss or damage of
    personal belongings of beneficiaries, volunteers, or visitors on its
    premises or during its activities.
  • 8.4. Health and Safety: The Trust will take reasonable measures to ensure the
    health and safety of participants in its programs and on its premises.
    However, it is not liable for accidents or injuries that occur despite
    such reasonable precautions.
  • 8.5. External Links:
    The Trust’s communications or website may contain links to external
    websites. The Trust is not responsible for the content, practices, or
    reliability of these external sites.

9. Governance, Compliance, and
Dispute Resolution

  • 9.1. Governance:
    Al Habib Educational Welfare and Trust operates under a legally registered
    Trust Deed in India. Its operations are overseen by a Board of
    Trustees/Governing Body responsible for strategic direction, policy, and
    compliance.
  • 9.2. Legal Compliance: The Trust is committed to operating in full compliance
    with all applicable laws and regulations of India, including but not
    limited to the Indian Trusts Act, the Income Tax Act, and any specific
    laws pertaining to NGOs, education, child welfare, and social work in Bihar.
  • 9.3. Amendments:
    The Trust reserves the right to modify or update these Terms and
    Conditions at any time. Changes will be effective upon posting on the
    Trust’s official communication channels. Continued engagement with the
    Trust after such modifications constitutes acceptance of the revised
    terms.
  • 9.4. Governing Law and Jurisdiction: These Terms and Conditions shall be governed by and
    construed in accordance with the laws of India. Any disputes arising out
    of or in connection with these Terms and Conditions shall be subject to
    the exclusive jurisdiction of the courts in Madhubani, Bihar, India.
